Section 3
Number and boundaries of rural municipalities and municipalities

(1) The determination of the number of rural villages and municipalities and the boundaries of the open charkilas shall be in accordance with sub-section (3) of Article 295 of the Constitution.
(2) Based on the number of rural villages and municipalities determined by the Government of Nepal in accordance with sub-section (1) or border population, geography, administrative accessibility, state of infrastructure development, economic capability, availability of natural resources, linguistic, cultural and community structure, sub-section (3) and ( 4) will be able to be manipulated. However, the number and boundaries of one district's rural municipality or municipality will not be changed to fall in another district.
(3) If there is a change in the number or boundaries of the rural municipality or municipality, the assembly of the rural municipality or municipality affected by such change must pass a resolution by a two-thirds majority of the members and send it to the provincial government.
(4) Within fifteen days of receipt of the proposal according to sub-section (3), the provincial government shall make a recommendation to the Government of Nepal to change the number or boundaries of the rural municipality or municipality in accordance with the proposal.
(5) If there is a need to change the number and boundaries of rural municipalities or municipalities, it should be done at least one year before the date of elections for rural municipalities and municipalities.
